Dealer Loses Licence to Sell

Toronto, November 09, 1998 – As
a result of allegations of
odometer tampering and employing
unregistered salespersons,
Jacobs Sales & Service Inc., and
John Jacobs of Wellesley,
Ontario, have had their licences
to sell motor vehicles in the
province revoked.
The revocation took place in
August 1998 after the Ontario
Motor Vehicle Industry Council
(OMVIC), the administrative
authority which regulates car
dealers and salespersons, filed
a proposal to revoke both
licences with the Commercial
Registration Appeals Tribunal.
Following a hearing, the
Tribunal upheld OMVIC’s proposal
and ordered the licences
revoked. Jacobs Sales and
Service Inc., and John Jacobs,
suffered yet another setback
last week after the Tribunal
rejected the company’s argument
that a stay be granted pending
appeal to Divisional court. Had
the stay been granted, the
company and Mr. Jacobs would
have retained their licences to
sell cars until the appeal was
heard.
The Tribunal reasoned that
granting a stay would have put
the public interest in jeopardy.
The ruling supported OMVIC’s
fear that the former dealer
would not conduct himself with
honesty, integrity and in
accordance with the law, if he
were allowed to remain in
business.
Since the beginning of 1998,
OMVIC has issued over 200
proposals to revoke existing
licences or to refuse
registration privileges.
