The Ontario Motor Vehicle Industry Council (OMVIC) advises consumers and dealers that Fleetwood Auto and its owner John Byers are not registered in Ontario to sell vehicles. The dealership’s registration was revoked in January 2009, but it appears the owner is continuing to sell vehicles from 4712 Dunlop Street West in Barrie under the name Asset Distribution and Repo Centre.
Byers’ registration was revoked as a result of consumer complaints, numerous Highway Traffic Act convictions, indebtedness to the Ministry of Revenue and indebtedness to the Motor Vehicle Dealers Compensation Fund. The dealer appealed this decision of the Licence Appeal Tribunal (decision available at
www.omvic.on.ca/info/enforcement/lat/LAT%202009-01-12b.pdf) to Divisional Court, however the appeal was
abandoned.
In Ontario, all motor vehicle dealers and salespeople must be registered with OMVIC before buying, selling or leasing vehicles. Consumers who purchase vehicles through unregistered dealers are not protected by provincial legislation, including the right to make claims to the Motor Vehicle Dealers Compensation Fund. Dealers who knowingly trade with an unregistered dealer are also subject to sanctions under the Motor Vehicle Dealers Act and Code of Ethics.
