Cancelling an Agreement

The Consumer Protection Act (CPA) defines as unfair practices those involving false, misleading, deceptive or unconscionable representations.

bullet.gif Only when they have been victims of such practices – and not out of a change of mind – are consumers entitled to request the cancellation of an agreement.

Provided that some of the conditions defined as unfair by the CPA apply to your vehicle purchase, you may send a letter to the dealership informing them of your intention to cancel the agreement.

Below is an example of how your rescission letter to the dealership should be worded. Send your letter by registered mail, courier, or hand-deliver it, and obtain a receipt.

On [insert date], I/we purchased/leased a [place type of vehicle & Vehicle Identification Number here] from you at a cost of $[insert amount paid].

I have recently found out some material information about this vehicle. Specifically, I have found out that [insert description of material fact]. If I had known about this before I acquired this vehicle, it would have changed my decision to purchase/lease it.

II have attached the following documentation regarding this material fact for your review:

[List as many as appropriate]

  • Vehicle history report (e.g. UVIP, CARFAX, CarProof etc.)
  • Mechanic's report
  • Warranty records
  • Information from previous owner
  • Vehicle service records
  • Report from MTO
  • Kindly review this at your earliest convenience.
  • Based on this information, I would like to cancel my agreement to purchase/lease this vehicle.

OR

I would like you to advise me what you are prepared to offer by way of compensation.

I look forward to your reply by [insert date]. Your anticipated cooperation is appreciated.
