The enforcement process

OMVIC enforces Ontario’s consumer protection legislation related to vehicle sales. In carrying out this role, OMVIC utilizes inspections, disciplinary processes and action, investigations, prosecutions, and a Licence Appeal Tribunal.

How we make sure the law is followed

OMVIC uses a range of information sources to regulate industry conduct. Applications for registration or renewal of registration are detailed, and the information is verified through public and non-public methods.

OMVIC also works closely with other law enforcement agencies to identify persons engaged in illegal activities. Tips and complaints often lead to enforcement action.

We conduct routine inspections of registered dealers to check that they are adhering to all legal requirements.

We conduct mystery shop campaigns across Ontario where we pose as consumers, seeking out non-compliant advertising and unregistered salespersons. Dealers and salespersons who fail a mystery shop may receive administrative action.

We investigate unregistered activity and misconduct. OMVIC’s investigators are empowered to lay charges under a number of provincial statutes.

Every day Ontario motor vehicle dealers and salespeople demonstrate high ethical standards, selling over one million vehicles a year. In those instances where a dealer or salesperson fails to meet their legal and ethical obligations, they may be subject to the discipline process.

OMVIC is required to make certain information available to the public, including information related to charges laid by OMVIC investigators against dealers and salespersons and convictions.

OMVIC’s registrar may issue a proposal to suspend, refuse or revoke registration. The registrar’s proposal can be appealed to the Licence Appeal Tribunal (LAT) which is an independent tribunal that hears appeals of Proposals.
