The MVDA sets out specific information related to a vehicle’s past use, history and condition that MUST be disclosed. Just as a dealer would want these facts when purchasing a vehicle or accepting it in trade, the Act requires dealers to provide this information to customers.
These disclosures must be clearly, comprehensibly and prominently written on the contract and be presented in a timely manner so the customer can review them before signing the contract.
There are sophisticated vehicle history reports available to all consumers, so it is in a dealer’s best interest to know the history of the vehicles they offer for sale or lease and make proper disclosure to any customer.
