Refusal of Registration

A proposal to refuse registration of a dealer or salesperson may be issued if OMVIC’s Registrar believes:

  1. The applicant cannot reasonably be expected to be financially responsible in the conduct of business.
  2. The past conduct of the applicant affords reasonable grounds for belief that the applicant will not carry on business in accordance with the law and with integrity and honesty.
  3. The applicant (or an employee or agent of the applicant) makes a false statement (or provides a false statement) in an application for registration or for renewal of registration. Note: making a false statement not only disqualifies the applicant from registration, it is also an offence under the Act; charges could be laid.
  4. The applicant has failed to comply with terms and conditions of registration.

OMVIC can refuse, revoke or suspend registration of a corporation if:

  1. The applicant cannot reasonably be expected to be financially responsible in the conduct of business:
    1. Based on the corporation’s financial position; and/or
    2. Based on the financial position of its officers or directors.
  2. The past conduct of the corporation’s officers or directors affords reasonable grounds for belief that its business will not be carried on in accordance with the law and with integrity and honesty.
  3. An officer or director of the corporation makes a false statement (or provides a false statement) in an application for registration or for renewal of registration.
  4. The applicant/registrant has failed to comply with terms and conditions of registration.

Note: It is a strict condition of registration that no person alter or remove a VIN label, or buy or sell a vehicle whose VIN is defaced or unrecognizable.
