A former Scarborough car dealer, Min Tian o/a Nice Auto Sales, pleaded guilty to retaining an unregistered salesperson, contrary to the Motor Vehicle Dealers Act (MVDA), and was fined $12,500. Tian was charged by OMVIC, Ontario’s vehicle sales regulator, for allowing her husband, Zhijun Wang, to use her OMVIC Registration and ID to gain access to wholesale vehicle auctions where he purchased numerous vehicles. Many of the vehicles were then sold with rolled back odometers or altered VIN’s. Wang was also charged by OMVIC for acting as an unregistered salesperson: he was convicted and fined $25,000.
OMVIC became aware of the serious allegations that led to the charges in late 2017. At that time the registrations of Min Tian and Nice Auto Sales, who operated at 4032 Finch Avenue East, Scarborough, were suspended. They have since been revoked. Only OMVIC-Registered dealers/salespeople/staff, auction staff and OMVIC or other law enforcement personnel, are to be granted access to wholesale auctions; only registrants may attend for the purpose of bidding on, or acquiring vehicles.
Ontario's Motor Vehicle Dealers Act (MVDA) requires that all dealers and salespeople be registered with OMVIC. Dealer and salesperson registration can be easily verified on OMVIC’s website, or by calling OMVIC directly (1-800-943-6002). Unregistered selling (curbsiding) is a serious offence. Individuals convicted of curbsiding can be fined a maximum of $50,000 and/or be jailed for up to two years less a day.
OMVIC (Ontario Motor Vehicle Industry Council) administers and enforces the Motor Vehicle Dealers Act (MVDA) on behalf of the Ministry of Government and Consumer Services. OMVIC maintains a fair and informed vehicle sales marketplace by regulating dealers and salespersons, regularly inspecting Ontario's 8,000 dealerships and 28,000 salespeople, maintaining a complaint line for consumers and conducting investigations and prosecutions (or discipline proceedings) of industry misconduct and illegal sales (curbsiding). OMVIC is also responsible for administering the Motor Vehicle Dealers Compensation Fund on behalf of its Board of Trustees.
The Motor Vehicle Dealers Compensation Fund is funded by Ontario's registered motor vehicle dealers and provides compensation to consumers who have a valid claim against an Ontario-registered dealer. Qualifying consumers may be eligible to receive up to $45,000 for each valid claim to the Compensation Fund. Since its inception on July 1, 1986, the Compensation Fund has reimbursed consumers more than $5 million.
